Bestbiit/Bluebiit: Illegally spamming to advertise electronic gadgets

Bestbiit Oy (see biz reg), d/b/a Bluebiit, a Finnish startup, is spamming to advertise its goods, and I already mentioned them in this capacity elsewhere.  There is nothing inherently surprising about this.  Their spams have no plaintext content, so they violate every item of the spam legislation (not being identifiable as marketing, not having a mechanism for removal, and not describing the address list used).  Unfortunately the Helsinki City Marathon organisation allowed them on as a sponsoring vendor (so I got to tell them off to their face; “we remove everybody who complains” said the young man and probably believed it was OK to spam as long as you did; unfortunately it’s not even true that they would do that) and they’ve got our recent Olympic silver medalist as a promotional face, too.  Shame, shame!

Since this was legal B2B spam to begin with as far as my business is concerned, I duly complained to them on August 9 and got no response (if you don’t count the abuse/postmaster bounces… and a swift reply from one participating ISP who promptly announced they would be cutting off all services to them), but I got more spam on August 24, so it’s illegal on one more count: disrespecting the opt-out of the recipient.

They’re hitting outdated and erroneous personal addresses, and they’re using a purchased list (or several) by their own admission; the HTML content says their addresses come from markkinointirekisteri.fi (who have been forbidden from processing data related to this business and selling it as early as August 2010) or Haiku Digitoimisto (who, either, don’t have required role accounts – such a good thing for an ESP) but it’s impossible to identify which, of course.

Spam-advertised website: http://www.bluebiit.com used to be on LeaseWeb to begin with, but is no more. Go Alex!
