JAM Software: sending to outdated addresses, not respecting opt-out

JAM Software are mailing addresses at a domain they know to have changed hands. They’re ignoring the opt-out, too. So, it’s just spam now. I’ve also forwarded one of these (in Dec 2010) to the person named in the mail at his current address; no reaction, and mail to this outdated address continues, too.

Opt-out on March 26, 2010.  I don’t think I have any bounces for this. There is no RFC-Ignorant correlation of it either, so I figure it’s been delivered.

You're trying to mail something to addresses @atro.fi.

Savon Voima (a power generation company in eastern Finland) gave up
this domain name on August 31, 2009.  It properly expired after the
three month probationary period on November 30, 2009.  On December
29, 2009, I registered it for myself as a private person.

All email that you send to addresses @atro.fi is bounced with 550 5.1.1
No such user at the present time, which should be the final clue that
you need to manage mailing list hygiene properly.

In a bit, I will be turning on catchall on the domain and all mail sent
to those addresses will feed the spam database of a fairly well known
international DNSBL.  Sending any mail at all to previous addresses of
Savon Voima employees will result in DNSBL listings for spam after that.

Thank you for attending to this.

  1. I have a response.

    Dear Atro Tossavainen,

nice to see that you are not able to use the appropriate unsubscribe link, but instead posting this issue on the net. Probably Savon Voima Oyj will be very much interested about the fact that you are offering access to their personal data on the net, as well.

Don’t hesitate to contact us again, if we can be of further assistance.

    Best regards,

    • A certain Herr Bubacz appears to think that refusal to use unsubscribe links is the same as inability to do so. He also seems to think that recipients of spam should shut up and eat it. He *also* seems to think that public complaints about spam violate some sort of data privacy law.

As we Americans like to stay, three strikes and you’re out.

I’d suggest that JAM Software might want to send somebody *else* to respond to this issue, preferably somebody who understands spam issues and hasn’t got a great big chip on his or her shoulder. :/

  2. Grüezi Falk-Rafael,

I don’t unsubscribe from mail I didn’t subscribe to. See my blogger profile here.

But I might occasionally take it upon myself to kindly let various people know that the domain has changed hands so that they might follow the requirements of the Data Protection Directive and no longer process outdated or erroneous personal data, which is what you appear to be doing.

I let you know about that on March 26, 2010. You didn’t listen, and now you’re here whining about it.

“Their” personal data? “x@atro.fi” doesn’t very much qualify as personal, so excuse me íf I have to LOL a little here.

It bears to be mentioned that Savon Voima Oyj made a conscious decision to abandon the use of the domain name atro.fi towards the end of August 2009. Whatever follows is similarly a conscious decision by them. But you’re welcome to let them know. It’s not like they don’t know – I have been in touch with them at the time because I specifically inquired (during the quarantine period) whether I might have the domain for myself afterwards.

    Mit freundlichen Grüssen,
    Atro

  3. > Grüezi Falk-Rafael,

“Grüezi” means “Hello” in Switzerland. Jam Software is not a Swiss company; it is located in Germany, where you would say “Hallo”.

    > I don’t unsubscribe from mail I didn’t subscribe to. See my blogger profile here.

I can second that, I never unsubscribe as well to mailings I have never opted-in to. Is it that difficult to automatically delete addresses that get a “User not known” error?

As a side note, I use software from Jam and I find it really good, but their answer is worse than most I have read before.

    • Of course I can’t know if they tried to send any mail during September 1, 2009 to December 28, 2009, which is when the domain didn’t have any mail servers at all and any attempts to send mail would have been met with “domain not found”, which should have led to the removal.

I’m quite sure they didn’t mail anything between December 29, 2009 and mid-March 2010, which is when they would have received a 550 5.1.1 No such user from my mail server. After all, on March 26, 2010, I had an actual message text that I could reply to. But anyway: I responded, told them the domain has changed hands, and that should have been the end of the story. It wasn’t.
