MailerLite again
In a blog post titled Email Segmentation Without User Data, MailerLite, aka UAB “Itema”, are putting forth the view that you should be “segmenting” by sending your contacts more email about the same basic idea with different subject lines to see which email performs the best.
Now this doesn’t really address the point of whether you’re sending by permission or without it, and of course MailerLite’s policies (ToS, privacy policy and anti-spam policy) read just fine, but our previous experiences with MailerLite suggest that even their own idea of what is acceptable may not be quite as highbrow as put forth in those documents.
Discussion on several anti-spam mailing lists is currently centering on the topic of how to best avoid MailerLite pre-emptively in its entirety, by IP, domain name, shoe size and other relevant parameters…
A note to “jmtapio”: MailerLite have been informed of the fact that Valkila sends Finnish B2B spam through their service no later than Dec 1, 2012. I’ve just been through the logs on my spamtraps and I see that Valkila has still been spamming traps through MailerLite in February 2014.
As an aside, their newsletter violates Section 15 of the Business Information Act by not including all relevant information about the sender, Section 25 of the Personal Data Act by not including anything at all about the file of personal data that they’re using, Section 26 of the Act on the Protection of Privacy in Electronic Communications by being UCE to natural persons without consent, prior customer relationship or “business position justification”.
Just checked my logs and I seem to have reported all of the instances I have reveived spam from them, but to no effect. I also noticed that they are on the Suomispam DNSBL. They clearly don’t mind sending spam.

That’s clearly not some random bad apples here and there. That looks like systematic spamming and ignoring abuse reports. I wonder if there is any good mail leaving their servers or if it’s all spam.

Arno, you must be new at MailerLite. Ask Ronaldas Merkliopas how often you have received spam complaints from Finnish recipients and whether you’ve actually done something about those senders.
Mails sent from your platform continue to violate the Finnish law, such as by not including the legally mandatory information on what the address list was.
Unsub and other such information must be in Finnish (if the message is in Finnish) or in Swedish, if the message is in Swedish. English is not one of the official languages of Finland.
Digimarketinghelsinki at gmail.com and es-tarjous at mpoli.fi are spamming. I have a few others too, but those are the most prominent at this time.
