Finnmatkat, a Finnish travel agency, appears to be using tell-a-friend marketing as an excuse to spam. The spam claims to have been sent by IT-Systems Finland Oy (it-systems.fi), but that’s only a HELO name (although the Message-ID domain goodland.fi is registered to them too…). The sending network is owned by Tenue Oy, and the rDNS domain of the sending IP address, myrootshell.com is registered personally to the NOC of Tenue, Mr Sami Holopainen.

Unfortunately the Finnish Data Protection Ombudsman‘s document on “tell a friend” marketing is only available in Finnish and Swedish. To cut a long story short, the kind practiced here is forbidden as it is nothing but a lame attempt to circumvent the requirements of the Act on the Protection of Privacy in Electronic Communications and the Personal Data Act. What’s really lame is that it appears as if the supposed friend who did the telling and the friend who was told are one and the same.

Needless to say, the message does not:

• adequately identify the sender
• indicate the personal data file used or its maintainer
• indicate how to be removed from the list

And it is UCE to a natural person’s address, too.
