Tavoite Media / Lateralus Enterprise: Offering e-marketing consultation to spamtraps

A young man from Espoo, Finland, a private person carrying on trade under the primary name Lateralus Enterprise d/b/a Tavoite Media, who objects to being named here and has enlisted the help of the Data Protection Ombudsman’s Office to have his name stricken from this blog, is spamming to offer his e-marketing consultation services. I’ve seen his spam at my own business starting August 2011; apparently he’s managed to listwash my business (easy enough) but unfortunately for him, my ancient spamtraps contain some addresses that are in the Finnish Business Information System too, so I get his spam this way.

  1. Directi have suspended and de-obfuscated the obfuscated domain registrations of e-markkinointi.net and greenrecycling1.com. The former was the same spammer. Of course. The latter is his Indian collaborator du jour.

  2. Listwash? Hardly. It was just coming along in the queue.

    Dude spammed my business address with this too, thereby violating Section 27 of the Act on the Protection of Privacy in Electronic Telecommunications – as I had opted the business address out of anything Tavoite Media / Lateralus Enterprise / Filip Poutintsev might send on September 19, 2011. I cc’d the Data Protection Ombudsman on my opt-out that day, so they know and can correlate the complaint I will now send with that.

  3. The spammer must be rather bored of the fact that Directi terminate domain names involved in spamming, so he has resorted to spamming from domains that are not registered at Directi (digital-publishing.net), with advertising content that hides the identity of the sender/beneficiary in violation of Section 28 of the Act on the Protection of Privacy in Electronic Telecommunications, and all the spam-advertised addresses being IP address literals.

    I clicked on a link, obfuscating the tagging with garbage. Sure enough, it took me to http://bisnesrekisteri.com, registered to the same registrant, registered at Directi…

In a surprise move, the spammer has written to my business to ask me to remove all personal information of his I have posted on this site, on my business’ site, and anywhere else I might have done it (as if I controlled the entire Internet, or as if I was obliged to do his legwork for him…) and to stop harassing him. It just so happens that all of the information I have posted is public anyway through its nature or deliberately made public by himself, and all in connection with his business, and the business of his business happens to be spamming. There’s an easy way not to come to my attention: don’t spam.

    • It gets better. The Data Protection Ombudsman is parroting the spammer’s requests, so I actually had to answer them on why I’ve republished any information related to this spammer! Entire response (wrote it in English right away…) available on request, send email, too long to include here.

  5. This post was edited to omit most of the explicit references to the name of a spammer who objects to being named and sent the Data Protection Ombudsman to do his bidding.

  6. Does the Data Protection Ombudsman have the authority to force people in Finland not to name spammers who spam them? That is decidedly news to me.

    • Send me an email and I’ll send you the response I sent the DPO. There’s another response from them that I haven’t gotten around to yet, but the bottom line is they’re not happy with what I said about Tavoite Media / Lateralus Enterprise being a registered business and henceforth public in all respects.

    • Here goes.

      They refer to a statement given by the workgroup of national DPOs on the nature of personal data, dated June 20, 2007. It’s supposed to be attached, but isn’t,

      They also refer to a judgment given on November 6, 2003 (C-101/01) on the publishing of personal data on a private Internet site (also supposed to be attached, but isn’t),

      and ask how circumstances arising from these documents would change my response to them, if at all.
